IMPORTANT NOTICE: Zion Broadband Inc. (referred to as "Zion") reserves the right to discontinue service or deny access to anyone who violates our policies or the terms and conditions outlined below WITHOUT WARNING OR PRIOR NOTICE. No refunds of fees paid will be issued if account termination occurs due to violations of these terms.

1. Eligibility

This offer may not be combined with any other offers. Zion retains sole discretion in determining eligibility for participation. Standard professional installation of the router and customer premises equipment (radio transmitter/receiver) is required for wireless access, with all necessary mounting hardware included.

2. Monthly Fees and Payments

Monthly payments can be made via Zion's online portal, mailed in, or dropped off at our office. Accepted payment methods include credit or debit cards, PayPal, and bank drafts through the online payment portal. Payments can be made as one-time transactions or set up for automatic recurring billing.

3. Unsolicited Email (Spam)

Unsolicited commercial advertisements (spam) are strictly prohibited. Any account found to be sending spam originating from our servers, or advertising domains hosted on our servers, will likely result in cancellation of services. Zion maintains a zero-tolerance policy toward spam.

4. Installation of Fixed Wireless Equipment

Zion retains ownership of all customer premises equipment. This equipment includes the wireless radio and router (if supplied by Zion). Upon cancellation of services, all equipment must be returned to Zion. Customers grant permission for Zion to retrieve equipment upon termination or cancellation of service. If a tower is required, Zion will provide and install it at the customer’s request for an additional fee. The tower will remain the property of the customer.

5. Network Security

Customers may not use the Zion network to circumvent user authentication or security measures of any host, network, or account. This includes, but is not limited to:

  1.      Accessing data not intended for the customer

         Logging into unauthorized servers or accounts

         Password cracking or manipulating TCP/IP packet headers

         Probing, scanning, or testing the vulnerability of any system or network without proper authorization. 

    •      Interfering with service to any user, host, or network, including flooding, mail bombing, or other deliberate attempts to overload or crash a host or network.
    • 6. Acceptable Usage

  2. The standard internet access services provided by Zion are designed for casual home users. Activities deemed as "extreme heavy usage," as determined solely by Zion, may result in service interruption, additional charges, or termination of services. Extreme usage includes, but is not limited to

     Running any type of file server or website on the Zion network   

     Using peer-to-peer software (e.g., Limewire, Morpheus, Kazaa, BitTorrent, Gnutella)

     Providing game servers for others to play via the internet

     Offering email or fax services beyond personal use.

  •      Any other activities classified as extreme usage at Zion's discretion. 

7. Compliance with Texas Law

These Terms of Service are governed by the laws of the State of Texas. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Gaines County, Texas, and you consent to the jurisdiction of such courts.

8. Limitation of Liability

To the fullest extent permitted by Texas law, Zion shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless Zion, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses arising out of or related to your use of our services, violation of these Terms, or violation of any rights of another party.

10. Changes to Terms

Zion reserves the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the updated terms on our website. Your continued use of our services after such changes constitutes your acceptance of the new terms.

  • Real-Time Services: High-priority is given to latency-sensitive applications such as VoIP, video conferencing, and online gaming.
  • Other Traffic: Non-real-time services such as email, file downloads, and web browsing may be subject to lower priority during peak congestion periods.

We do not discriminate against specific applications or services but may employ reasonable traffic management techniques during peak periods to prevent network degradation.

1.2 No Blocking or Throttling

We do not block or throttle access to lawful content, applications, services, or non-harmful devices, subject to reasonable network management practices. Our goal is to maintain an open internet and provide fair access to all lawful resources online.

1.3 Application-Specific Behavior

We do not favor or degrade the performance of any specific content or application provider. However, certain applications that consume a disproportionate amount of bandwidth may be subject to reasonable management practices during periods of congestion.

1.4 Device Attachment Rules

Zion Broadband Inc. permits the use of any lawful, FCC-compliant device that is compatible with our network. However, if a device poses a risk to network integrity or causes harm to other users, we reserve the right to restrict its connection.

1.5 Security Practices

We actively monitor our network for security threats, including malware, viruses, and denial-of-service (DoS) attacks. We use measures such as firewalls, encryption, and traffic filtering to protect the network and our customers from malicious activities.

If a device or customer is found to be involved in activities that compromise network security, we may take action, including limiting or suspending access to the network.

2. Data Usage Policies

Our fixed wireless internet service is subject to data usage policies that may include monthly data allowances. When customers approach or exceed their data allowance, we may reduce their internet speeds during the remainder of the billing period or charge for additional data usage. These practices are designed to ensure fair access for all customers.

3. Performance Characteristics

Our fixed wireless service delivers internet speeds up to the speeds advertised in your service plan. However, actual speeds may vary depending on several factors, including:

  •      Network Congestion: Peak usage times may result in temporary reductions in speeds.
  •      Environmental Factors: Weather, physical obstructions (e.g., buildings, trees), and interference from other wireless signals may affect performance.

We aim to provide our customers with an internet experience that supports typical online activities, such as streaming, web browsing, and video conferencing.

4. Network Monitoring and Transparency

We are committed to transparency in how we manage our network. Customers can view their data usage, service plan details, and any applicable restrictions or usage policies through their online account or by contacting customer support.

We regularly monitor network performance and usage patterns to ensure that our network remains efficient and secure. We do not engage in deep packet inspection (DPI) or monitor the content of communications beyond what is necessary for network management and security.

5. Impact on VoIP and Other Services

Zion Broadband Inc.’s network management practices do not target specific types of services, but customers using Voice over IP (VoIP) or other latency-sensitive services may experience temporary performance degradation during periods of network congestion. However, we prioritize real-time traffic to ensure optimal performance for critical services.

6. Complaints and Resolution

Customers who have questions or concerns about our network management practices or feel that their service has been unfairly impacted may contact our customer service team for resolution. We will investigate and resolve any concerns in a timely and transparent manner.
